TICKET LICENSE AGREEMENT THIS IS A REVOCABLE LICENSE/USER ACCEPTS RISK OF INJURY This ticket is a revocable license (this “Ticket”) and grants to ticket holder, on behalf of ticket holder and any minor accompanying holder (“TH”), each one (1) admission to Mercer Labs: Museum of Art and Technology (“MOAT”). By accepting this Ticket, TH certifies that he/she accepts and agrees to abide by the terms of this Ticket and the Rules and Regulations of MOAT (posted in full at (www. mercerlabs.com) (the “Rules”) which may be modified, amended, or supplemented at any time by LA.

1. Tickets & Conditions of Use. (a) This Ticket may be revoked at any time in MOAT’s sole discretion without refund or other consideration. (b) All sales are final, non-refundable, and TH is solely responsible for safeguarding such Ticket. Lost, stolen, forgotten, unreadable or destroyed Tickets will not be replaced. The use of counterfeit or invalid tickets is prohibited. (c) The duplication; reprinting; advertising, promotion (e.g. contests, sweepstakes, commercial endeavors); or resale or attempted resale of this Ticket in violation of applicable law or without express written permission of MOAT is prohibited and grounds for seizure or cancellation. (d) MOAT may bar or eject from current or future admission to MOAT, without refund, any TH who: (i) fails to comply with any term of the Ticket, the Rules, and/or any instructions of MOAT staff; or (ii) acts in an inappropriate, dangerous or disorderly manner. (e) TH consents to the inspection of his/her person and personal property before entering and/or while at MOAT. MOAT reserves the right to refuse any person MOAT admission and to remove any person refusing such inspection and/or any person who upon inspection is deemed by MOAT (in its sole discretion) to have unlawful, dangerous, or otherwise inappropriate or prohibited items. In addition to those identified in the Rules, the following items may not be brought into MOAT: alcohol, weapons, and animals (except Service Assistance Animals). TH agrees not to record or transmit for profit, or aid in recording or transmitting for profit, any description, account, picture, or reproduction of any part of MOAT, its marks or logos without the prior written approval of MOAT. (f) TH may not solicit contributions or distribute literature at or around MOAT. (g) TH grants permission to the Indemnitees to utilize TH’s image or likeness incidental to any live or record video display or other transmission or reproduction in whole or in part of MOAT in press, marketing and social media.

2. Disclaimer and Limitation of Liability and Scope. (a) TH expressly assumes all risk of property loss, personal injury and/or sickness incidental to or arising from TH’s presence at MOAT and releases MOAT and the Parties (as defined below) from any liability with respect thereto. (b) Adult (18 years of age or older) supervision of minors (below the age of 18 years) is required at all times while within MOAT. (c) MOAT hours of operation are subject to change at any time and LA reserves the right, in its sole discretion, to delay, postpone or cancel the opening of MOAT. (d) TH agrees to release, indemnify and hold harmless 21 Dey Management LLC, GCN Experience LLC and each of their respective parents, subsidiaries, and affiliated entities, franchisors, shareholders, and each of their respective officials, partners, members, directors, officers, trustees, principals, employees, servants, contractors, beneficiaries, licensees, successors, assigns, agents, and representatives, etc. (collectively the “Parties), from and against any and all claims, obligations, liabilities and causes of action (including related costs, expenses, attorneys’ fees and disbursements) accruing against or in favor of and/or incurred by TH and/or any minor(s) who is/are accompanied thereby, whether by reasons of personal injury or death or property damage or otherwise, arising out of or in connection with TH’s and/or any such minor’s(s’) possession or use of a Ticket or presence at MOAT (including any claims by or against any third-party vendor at MOAT). TH expressly acknowledges and agrees that the Indemnitees shall not be responsible for any loss, damage, or injury resulting from the aforementioned causes, nor for any lost, stolen, or damage property.

3. The galleries feature darkness, flashing lights, disorienting visuals, 3D sound, fog, mirrored surfaces, and optional physical experiences. Visitors with epilepsy, sensory processing disorders, claustrophobia, vertigo, or mobility or physical limitations should proceed with caution. It is recommended to wear pants, shorts, or tights to avoid excessive exposure on the reflective surfaces. Child and youth visitors should be under their adult guardian's constant supervision. Please alert staff immediately if you need assistance.

4. Photography notice.
Museum staff may photograph or record video during your visit. By entering, you consent to the use of your image in museum materials, including for promotional and commercial purposes.
